In that case, the court decided that lawyers can be reclassified from contractors to employees under certain circumstances, causing state and federal tax consequences. Dave Sprecace, Esq., has defended individual and corporate taxpayers in disputes with the IRS, Colorado Department of Revenue, Colorado Department of Labor and Employment, and US Department of Labor, both administratively and in state and federal courts, since 1993. Mr. Sprecace has successfully represented taxpayers in a wide variety of matters, including employment tax, income tax, and audits, among others. Mr. Sprecace’s business litigation experience includes representation of plaintiffs and defendants in federal and state trial courts and courts of appeal in many areas, including contract disputes, tort disputes, construction disputes, and other areas. Mr. Sprecace is licensed to practice before the IRS, the US Tax Court, the 9th and 10th Circuit Courts of Appeal, and several other federal district courts. He is also the 2012-13 Chair of the Colorado Bar Association Solo/Small Firm Section.
