As clients look for ways to obtain the most value for their money, and lawyers look for ways to ensure they will be paid for their hard work, the legal profession is experiencing a shift toward “innovative” fee agreements.  This program will cover the Rules of Professional Conduct as applied to fee agreements, including alternative billing arrangements such as flat fee agreements (you need benchmarks!) and changes to the fee agreement mid-stream (you need written disclosure!).  We will discuss hourly fee agreements, contingent fee agreements, flat fee agreements, replenishing retainers, how to limit the scope of your services in the fee agreement, and how to address potential conflicts of interest.  We'll also talk about a few “innovative” ideas that are absolutely prohibited.

About the Faculty:
 
Katrin Miller Rothgery is Assistant Regulation Counsel for the Colorado Supreme Court Office of Attorney Regulation Counsel.  In that capacity, she investigates and prosecutes lawyers in disciplinary, disability and contempt proceedings and handles claims made to the Client Protection Fund.  Prior to her work at OARC, Ms. Rothgery was in private practice with Snell & Wilmer L.L.P. where she practiced in employment law and commercial litigation.  She earned her law degree from Washington University in St. Louis and her undergraduate degree from the University of Notre Dame.  Ms. Rothgery is a member of the Colorado Bar Association and the Colorado Women's Bar Association and has been recognized for her pro bono work in the Denver legal community.
