Program Description:

The dog days of summer may be over, but the temperature in the CLE classroom is still HOT, HOT, HOT! That's because the theme for this year's Real Estate Fall Update is the hottest topics in Colorado real estate today.

For example, you'll find out about the current trends in real estate opinion practice. The ABA, ACMA and ACREL have developed guidelines for typical and appropriate opinions, qualifications and assumptions in opinion practice. This program will discuss those guidelines as well as emerging issues for opinion givers and recipients. You will also learn about HOA assessment lien priority, including the recent case law concerning foreclosure of the super priority portion of an assessment lien and changes to UCIOA § 3-116. Learn what insurance products are currently available for your clients, and get the recent changes in the law affecting conservation easements.

And that's not all! There have also been recent changes in urban renewal legislation. End the day with an ethics presentation that will focus on lessons in lawyer ethics drawn from some of the most factually egregious cases in recent years - you might not believe what you hear!

Current Trends in Real Estate Opinion Practice

This program will discuss those guidelines as well as emerging issues for opinion givers and recipients, including, for example, current best practices with respect to reliance by third parties, scope of enforceability opinions, and appropriate opinion diligence.

What Real Estate Lawyers Don't Know About Insurance
So you have assisted in the acquisition of the property, obtained title insurance, received entitlements and plan approval. It is time to build. Depending upon the nature of development and the requirements of lenders, a bevy of insurance considerations must now take place, including Builder's Risk, Owner's Liability, General Liability (Contractor), Auto, Workers Compensation, Professional Liability (Architects and Engineers). What does my client really need and what products are currently available?
