This program will explore Rule of Professional Conduct 1.0 through 1.18, focusing on their relevance to estate planning, probate, and protective proceedings regarding competence, communications, confidentiality, and conflicts. There will be a detailed discussion on handling conflicts, especially when representing spouses, parents, and children. Finally, Gordon will call attention to special considerations and best practices when representing clients with diminished capacity (Rule 1.14, a commit-to-memory rule). A discussion of DEI issues is also included in the program.
