Program Description

When a potential heir or other person with standing believes that a will admitted to probate in Colorado was improper in some fashion, he or she can “contest” the will under Colorado's probate laws.  Typical grounds for challenging a will include evidence that the testator lacked “testamentary capacity” or was unduly influenced by a third party.

If your client is a potential heir or other party affected by a will being admitted to probate in Colorado, or if your client was the testator, you need a solid foundation in the law of will contests.  Understanding when a will is or is not validly created often turns on key probate evidentiary doctrines as well as important Colorado statutes and case law.  Whether you are a litigator, a trust and estate law practitioner, or just have a need to know, you need to understand the facts and laws underpinning the core issues in will contest lawsuits!

The program's expert faculty, including trust and estate law practitioners, will contest litigators, former Colorado judges and magistrates, and forensic, mediation and arbitration experts, will get you up to speed fast!  From the basics of testamentary capacity, to the important issues raised by the Dead Man's Statute and the Uniform Probate Code, to the important presumptions and inferences used by the courts in deciding will contest cases, attend this program and treat yourself to a full day of immersion in this fascinating area of Colorado law!
