The augmented estate election is not an automatic spousal inheritance right. Many times, it will fail under the particular facts involved. When should counsel for a surviving spouse consider the spousal elective share and make the augmented estate election?
 
This seminar will cover various considerations and real-world mathematical models germane to the augmented estate election under C.R.S. ยง15-11-201 et seq., including the circumstances and length of the marriage, the economics of the decedent’s and the surviving spouse’s assets, the nature and original location of assets and governing law, and the psychological implications of the asset disclosure requirements.
