Legal Tests for Capacity in Colorado
Uncertainty exists as to the legal test for capacity in Colorado, depending upon the documents involved.  Case law has left the question unsettled. A low bar has been set for capacity to execute a will. A higher standard may be appropriate for lifetime transfers. The complexity of the documents and other facts and circumstances may come into play.
