Does attorney-client privilege offer any protection to a fiduciary in litigation with beneficiaries? Unfortunately, the recent Jicarilla case from the U.S. Supreme Court offers little new direction or guidance to Colorado practitioners in finding an answer to this question.

Kelly Dickson Cooper, Esq., concentrates her practice in all areas of trusts and estates law, including probate, trust, estate and gift tax, fiduciary-related litigation, estate and trust administration, and estate planning. As part of the Fiduciary Solutions group, her practice includes the representation of corporate fiduciaries, individual fiduciaries, heirs, beneficiaries, and creditors, in the resolution of probate and trust-related disputes through mediation, arbitration, and litigation. Specifically, this includes disputes involving fiduciary misconduct, spousal rights, interpretation of wills and trusts, distributions to beneficiaries, will contests, fiduciary compensation, and disputes in which fraud, undue influence, and lack of capacity are at issue.
Ms. Cooper served as a judicial intern for the Honorable C. Jean Stewart of the Denver Probate Court. She is listed in The Best Lawyers in America® and was selected for inclusion in Colorado Super Lawyers Rising Stars in 2010 and 2011 for Estate & Trust Litigation.
