A lot happened in 2011 in the area of Civil Procedure. Are you up to date on the significant changes to rules and case law? In this hour, Mr. Rackham covers:
 
  • Changes made to the Colorado Rules of Civil Procedure. There were some significant changes, including changes to the way that virtually all deadlines in Colorado are calculated.
  • The Civil Access Pilot Project, which imposes substantial changes to the Colorado Rules relating to particular cases filed in Denver, Arapahoe, Jefferson, Gilpin, and Adams counties.
  • Recent amendments to the Local Rules of Practice in the U.S. District Court for the District of Colorado, which, among other things, dramatically alter the way that cases are handled by magistrate judges in the U.S. District Court. The recent changes will have a profound impact on the way cases are litigated in the U.S. District Court for the District of Colorado, at least as far as settlement conferences and alternative dispute resolution is concerned.
  • Important decisions from the Colorado Supreme Court, including several cases that significantly modified the law with respect to what information must be disclosed in a party's Rule 26 disclosures and modifying approaches to privilege. There was also a series of cases that significantly impact class actions under C.R.C.P. 23.
  • Important decisions from the Colorado Court of Appeals involving significant civil procedure issues such as pleading, discovery, post-judgment practice, and judicial disqualification. Colorado litigators should become familiar with the case law developments because they may have material consequences on active and future cases in Colorado.
