In September 2025, the United States Supreme Court stayed an injunction in the case Noem, et al. v. Vasquez Perdomo, et al., thereby allowing ICE, at least pending a decision on the merits, to stop someone based on their apparent race or ethnicity, whether they speak Spanish or speak English with an accent, their presence at a particular location, and the type of work they do (e.g., day labor).
Please join Colorado Law Professor P. Deep Gulasekaram as he discusses:
- racial profiling in immigration jurisprudence, from its origins in border enforcement to its current use in major American cities
- the disjuncture between race-conscious immigration enforcement under the Fourth Amendment and colorblind college admissions after the Supreme Court’s 2023 decision in SFFA v. Harvard, in which the Court concluded that a person’s race may not be considered as a criterion under the Equal Protection doctrine
- and the relationship between so-called “sanctuary” laws and federal responses, including race-conscious immigration enforcement, national guard deployments, DOJ litigation against municipalities, and grant claw-back attempts by federal agencies against non-cooperating jurisdictions.
