On March 4, 2024, the Supreme Court decided Trump v. Anderson, 144 S.Ct. 662 (2024). The court concluded that states have no power under Section Three of the 14th Amendment to disqualify a person from seeking or holding a federal office, especially the presidency.
Our presenter, Professor William Baude, will summarize the opinion and decipher its meaning. Professor Baude has argued that the Court’s conclusion completely inverts the structure of federalism designed by the framers of the United States Constitution, which explicitly permits states to craft laws and procedures governing federal elections.
