About the Institute:
 
Approximately 40 million Americans move each year.  On average we will each move at least five times during our lifetimes.  While most of these moves occur within the same city or the same general locality, a growing percentage of these relocations occur across county or state lines.  Shifts in the economy and the doubling of the divorce rate over the last 30 years are the most often cited reasons for the mobility in our society. Whether moves cause divorces or divorces cause moves may be one of those chicken or the egg questions.  Regardless there is a growing segment of the divorce population that has to address interstate issues.  Whether it is an action under the UCCJEA or an attempt to assert control over property located in another state, we all need a better understanding of the law and procedures related to such actions.
 
The 2013 AAML seminar is designed to assist the practitioner in dealing with situations where a party or an asset is located in another state.  When one or both parties are not Colorado residents one of the first questions should be does Colorado have jurisdiction to act.  When discovery needs to be taken in another state, what do we need to do?  When the parties own or have interests in property located in other states does Colorado have the ability to transfer ownership of such assets?  If trusts or marital agreements are created in other states - how are such agreements or instruments treated by Colorado Courts?  How should they be treated?
 
Our goal with this seminar is to provide the practitioner with the knowledge and the tools necessary to evaluate, negotiate and litigate (if necessary) actions which contain these interstate issues.
 
2013 was a busy year for our state and federal legislatures.  While the changes to the Maintenance and Child Support statutes have been talked about for months, there were a number of other statutory changes that need to be analyzed and incorporated into our practices. During our seminar we will address some of these “game changers” and their impact on parental responsibility cases.  
 
As a final bonus - or as a cautionary note - we will also be addressing key issues and obligations that are being imposed on practitioners and our clients by Obamacare and HIPPA.  These two acts will change our tax laws and our disclosure requirements, and thus, we as practitioners, need a working knowledge of these new acts in order to appropriately advise our clients and to avoid the severe penalties and fines for non-compliance.
