Preservation and Spoliation
Spoliation: It isn’t just an adverse inference you need to be concerned about! Lawyers involved in the suppression or destruction of evidence can find themselves not only on the receiving end of a sanctions order, but also the subject of a disciplinary complaint. This presentation will provide real-world examples of lawyers running afoul of Rules of Professional Conduct 3.3 (candor toward the tribunal), 3.4 (fairness to opposing party and counsel), or 8.4 (conduct involving dishonesty, fraud, deceit, or misrepresentation, or that is prejudicial to the administration of justice), by destroying documents or counseling their clients to do so, or by simply not understanding the clients’ preservation obligations in this modern-day ESI world.

Good Robot, Bad Robot: Emerging Technologies and Ethical Considerations
Emerging technologies like artificial intelligence are transforming the current practice of law and the future of the legal profession. However, using emerging and existing technologies to practice law raises complicated and complex ethical issues. What does AI mean for legal ethics, what should lawyers do to prepare for these changes, and how could AI help to improve the legal profession? While the general ethical duties of lawyers remain consistent and constant across all technologies, there are issues to consider that may impact our ethical duties of competence/diligence, supervision, and confidentiality and challenge the concept of what constitutes the unauthorized practice of law.
