Presenters will debate the tension between religious freedom rights of employers and anti-discrimination laws, including the Colorado Anti-Discrimination Act's inclusion of sexual orientation as a protected class. The presenters will also discuss the contraceptive mandate issued by the U.S. Department of Health and Human Services (HHS) and religious employer exemptions, and the recent high-profile decisions in the Hosanna-Tabor, Windsor, Hobby Lobby, and Abercrombie cases.

Colorado's Anti-Discrimination Act (CADA)
 
Presented by Steven A. Chavez, Esq., Director, Colorado Civil Rights Division, and Representative Joe Salazar, Esq. (D-Thornton)
 
CADA was amended in 2013 by Colorado House Bill 13-1136, entitled the “Job Protection and Civil Rights Enforcement Act of 2013.” The presenters will discuss these amendments, which go into effect January 1, 2015, including but not limited to, legislative intent and practical advice for practicing before the Colorado Civil Rights Division.

Employment Testing: ADA, USERRA and Ethical Implications

This presentation will cover the investigative technique of “testing” in the employment context, with a focus on discrimination in violation of the Americans with Disabilities Act and the Uniformed Services Employment and Reemployment Rights Act, including the logistics of testing, standing to sue, and ethical issues.
