Implicit Bias in Jury Selection

Program Description:
 
The right to trial by jury in criminal cases is guaranteed by the Sixth Amendment to the U.S. Constitution, as well as the laws of every state. "Voir dire," is Latin for "to speak the truth." In voir dire, the judge and attorneys for both sides ask potential jurors questions to determine if they are competent and suitable to serve in the case.
 
Most attorneys would agree there is both a science and an art to voir dire, and that your case can either be won or lost at this stage.
 
The science of voir dire involves both the court and attorneys questioning the potential jurors about their biases and backgrounds, as well as any pre-existing knowledge they might have about the case. The attorneys also ask questions designed to uncover characteristics or experiences that might cause potential jurors to favor either the prosecution or the defense. After they have completed questioning, the lawyers may remove potential jurors by making challenges for cause and peremptory challenges. Judges may also dismiss jurors who can't put aside their feelings and apply the law impartially-that is, without actual or implied bias.
 
The art of jury selection involves the attorney's attention to nuance, subtlety and psychology … intangible factors that influence an attorney's decision whether to keep or dismiss a juror.
 
Once the jurors are sworn in, so begins the next stage of trial.
