Program Description:
 
In 2013, Colorado's General Assembly overhauled our statutes governing pretrial release. Colorado's new laws recognize what decades of research has proven: that using money as a condition of release does nothing to guarantee community safety and future court appearances. By replacing bond schedules with empirical research and a presumption of release pending trial, the goal of the legislation is to decrease the number of people who are detained pretrial because they cannot post bond.

This program will give an overview of the new statutory scheme and some history behind bond. We have invited judges, prosecutors and defense lawyers to talk about how the new laws affect their obligations within the criminal justice system. After years of reliance on bond schedules, which have varied widely from one judicial district to the next, the legislative creation of a presumption of pretrial release and the retreat from bond schedules are changes that should generate discussion and participation from all stakeholders.
