Program Description
 
The fragile economy has refocused attention on how loans are secured with collateral.  Lenders are keen to ensure that the security interests they take are perfected correctly and that the collateral in question is adequate to secure the debt.  Borrowers are keen to receive loans and need a good understanding of the nature of the security interest and how it is created.  In the world of commercial law, taking a “security interest” in collateral is governed by Article 9 of the Uniform Commercial Code (UCC).
 
If you are new to UCC Article 9, or if you need a refresher, this is the CLE program for you!  This convenient, half-day program begins with the basics of collateral under UCC Article 9, including what sorts of collateral are covered by the article and how collateral should be described in financing documents.  The lecturer for this segment of the program is John E. Moye, a highly-regarded Denver commercial law attorney with many years of experience in this area.
 
After the basics, you will learn about the Colorado Secretary of State's new computer system for electronic filing of financing statements and other documents required to perfect a security interest under Article 9.  The third segment of the program will address “hot” issues that affect security interests under Article 9, such as taxes and judgment liens.  The program will conclude with a discussion of legal opinions that are often rendered on security interests created pursuant to Article 9.
