Kenneth R. Bennington

JAMS
Kenneth R. Bennington, Esq., After 40 years managing complex commercial litigation he brings to the dispute resolution process an irreplaceable perspective born of that experience. As a senior member of the bar, he has spent decades buried deep within the very same issues that he is now providing assistance as a mediator, arbitrator, and special master. Having worn the trial lawyer's shoes, he understands that while the process of successfully assisting the parties with resolving commercial disputes requires a grasp of the law and facts, it hinges in equal measure on an understanding of where the parties are coming from as well as on a dogged follow-up by the mediator. Specializing in banking, real estate, antitrust, trade regulation, and consumer protection litigation he knows the pressures, risks, and economics in play in the resolution of complex business disputes.  In particular, he understands the costs and benefits of alternative dispute resolution and the positive as well as destructive role discovery can play in fairly and economically resolving the dispute. Based on that experience immersed in complex litigation, Mr. Bennington is acutely aware of the parties' expectation of a thorough understanding of the issues, law, and dynamics from their arbitrator or special master. Never having settled for less as a practicing attorney, he holds himself to those same standards as a dispute resolution professional.
