Heather Tilley, Esq., is a litigation associate in the firm’s Denver Office and focuses her practice on complex business and intellectual property litigation matters with an emphasis on patent infringement as well as other types of intellectual property, including trademark, copyright, and trade secret. She also routinely assists clients with intellectual property protection and enforcement strategies. She has experience in litigating complex intellectual property matters and business disputes in federal and state courts, the US Patent and Trademark Office, and private arbitration. Heather regularly handles disputes related to patent, trademark, and copyright claims, ranging from breach of license agreements to ownership and authorship disputes to infringement of intellectual property rights. Heather also handles disputes related to trade secret misappropriation, false advertising, unfair competition, and breach of contract claims. Heather provides counsel to her clients with a unique blend of legal, engineering, and accounting expertise, and is well-versed in the structures and needs of businesses. In addition to handling litigation, Heather frequently advises clients on intellectual property issues including avoidance of third-party rights, assessment of the nature, scope, and value of IP portfolios, strategies for generating revenue through licensing and litigation, and managing enforcement and licensing programs. From industry leaders to innovative startups, Heather handles matters across a wide range of areas, including biotechnology, biomedical devices, fashion and apparel design and manufacturing, toys and games, robotics, semiconductor processing, software, agriculture, publishing, restaurants, cosmetics, dietary supplements and tinctures, hemp, cannabis, music, fitness and personal wellness, renewable energy, internet-based technologies, and data management and licensing. Heather has litigated intellectual property and commercial dispute matters in courts throughout the country, including in the US District Courts for Colorado, the District of Delaware, and the Northern District of California. Heather has also represented clients before the United States Patent and Trademark Office as well as the Trademark and Patent Trial and Appeal Boards.
