Gibson DunnKevin Rosen is a partner at Gibson, Dunn & Crutcher LLP in Los Angeles, chairs the firm's Law Firm Defense Practice Group and has successfully defended over 75 legal malpractice lawsuits with aggregate claims exceeding $10 billion, as well as more than a dozen malicious prosecution actions and disqualification motions. For example, Mr. Rosen successfully won an arbitration verdict against claims for $600 million arising out of a pharmaceutical company acquisition and drug development agreement, as well as all outstanding fees owed to the firm and all defense costs; won an arbitration verdict against multi-million dollar claims for fraud and breach of fiduciary duty and an award of all of the firm's outstanding fees arising out of False Claims Act litigation; and won a jury verdict against aggregate claims of $20 million after a seven week trial involving estate planning, real estate development, and tax issues. Mr. Rosen also won reversal by the California Court of Appeal, after being hired post-verdict, of a $31 million malpractice and fraud judgment against a Chicago firm (Blanks v. Seyfarth Shaw, 171 Cal. App. 4th 336 (2009)). He has won summary judgment against claims of $539 million against a Boston firm alleging mishandling of a dispute regarding the manufacture, sale, and distribution of specialty wire and against claims of $275 million against a Los Angeles firm related to real property acquisition, environmental compliance, and construction contracting and financing. He has also won motions to dismiss in separate bankruptcy proceedings on behalf of Texas and other firms against Trustee and investor class actions for $260 million arising out of alleged Ponzi schemes; in a $300 million malpractice lawsuit against a Honolulu firm in connection with the sale of 22,000 acres in Hawaii; in a $78 million securities class action against a Midwestern firm arising out of health care facility municipal bond offerings; in a $250 million lawsuit against a Seattle firm in connection with a series of technology licensing agreements; and in a $30 million class action against a Chicago firm arising out of the tenancy-in-common investments. Mr. Rosen also obtained a walkaway settlement at trial for a New York firm in connection with a $25 million tax shelter malpractice claim; won dismissal during trial of multi-million claims against a Seattle law firm arising out of a series of hospital acquisitions; and won dismissal of a derivative malpractice action related to a hospital merger, effectively foreclosing such actions in California in the future (McDermott, Will & Emery v. Superior Court, 83 Cal. App. 4th 378 (2000)). In addition, Mr. Rosen is currently defending a number of law firms against individual and class action claims in federal, state, and bankruptcy courts and arbitration tribunals related to, among other things, patent prosecution and litigation, mortgage-backed securities, alleged Ponzi schemes, securities fraud and the sale of unregistered securities, corporate acquisitions, real estate development projects, and commercial transactions.
