Evans Case LLPDavid R. Struthers, B.A., J.D., VG.D., Of Counsel at Evans Case LLP in Denver and an attorney for forty years. The current practice of Mr. Struthers is limited primarily to probate litigation, plaintiff personal injury claims, expert witness work, fiduciary representation, and personal counsel work. During his career, he has been involved with or represented hundreds of clients and a wide variety of cases of every size and description. Relative to probate litigation he works in fiduciary representation, accountability, and advice to estate administration, will contests, trust disputes and Colorado Bar Association committee work and CLE presentations. This includes issues of capacity, undue influence, and other manifestations of the human condition surrounding estates, aging, injury, and wealth over-reaching. In the trust and estate arena, he has served as an expert witness in trust and estate matters offering opinions about fiduciary responsibility and breaches thereof, reasonableness of fees, and professional malfeasance and malpractice. Mr. Struthers has represented a broad range of individuals, non-profit entities, families, businesses, a homeowners association and employees in matters such as: professional claims necessitating personal counsel, personal injury claims; professional negligence matters; catastrophic-injury railroad and products liability claims; auto litigation of every dimension; insurance bad faith claims; health club and sports-related injuries caused by the negligence of others or by dismal product design. Mr. Struthers has also been engaged in or for: various employment and wage loss matters; collection actions; civil rights claims, wrongful death claims; catastrophic injury events, administrative matters; premises liability claims; legal representation for individual law enforcement officers; business disputes; real estate and contract disputes, and Title VII claims for sexual discrimination, sexual harassment, ethnic, religious, and racial discrimination, and age-related and ADA claims. His appellate experience includes writing for or arguing before the Colorado Supreme Court, the Colorado Court of Appeals, and the Tenth Circuit Court of Appeals. Mr. Struthers: served in the military from 1969-72; taught legal liability for nearly a decade at Metropolitan State University; has climbed 52 of the 54 Colorado fourteeners; sings baritone in the Colorado Symphony Chorus; and has been a frequent presenter or faculty member for the Trust and Estate Section of the Colorado Bar Association and before that, for the Colorado Trial Lawyers Association as a board member and presenter.
