Robert E. Benson joined Holland & Hart LLP upon graduating from the University of Iowa and University of Pennsylvania Law School, and has spent his entire legal career with that firm. He practiced in the areas of civil litigation and arbitration, with an emphasis on construction law, commercial disputes, professional ethics, and legal malpractice. Today, having retired from the full-time practice of law, his practice is limited to arbitration, mediation, early neutral evaluation, and dispute review boards. He is now Senior Counsel to the firm.
Mr. Benson is the founding chair of the Colorado Bar Association Construction Law Forum and has chaired many Construction Law Symposia. He is the founder of and served as Managing Editor and principal author of The Practitioner's Guide to Colorado Construction Law from its inception in 1999 through many years. He is co-creator and co-author through five editions of How to Prepare for, Take and Use a Deposition (James Publishing).
Mr. Benson has authored numerous articles published in Colorado Lawyer, including "Application of the Pro Rata Liability, Comparative Negligence and Contribution Statutes"; "The Power of Arbitrators and Court to Order Discovery in Arbitrations"; "Application of Comparative Negligence and Contribution Statutes to Third-Party Defendants"; "Application of the Federal Arbitration Act in State Court Proceedings"; and "Discovery to Nonparties in Colorado Arbitrations." He is a frequent speaker on construction law, alternative dispute resolution, and risk transfer and allocation contract clauses, as well as professional ethics. He has taught arbitration and mediation training courses.
Mr. Benson is the creator and author of this Colorado and Federal Arbitration Law and Practice: A Guide to Arbitration, Mediation, and Other ADR Procedures, this being the fourth edition.
For many years, Mr. Benson has been listed as a 5280 Magazine Super Lawyer, in Chambers U.S.A., in Best Lawyers, and in Super Lawyers. He has served as an arbitrator in more than 100 disputes and has mediated more than 150 disputes. He also has served on dispute resolution boards. These activities primarily have involved commercial and construction litigation.
