Wade, this comprehensive treatise is based on the seminal treatise by the late Howard E. Parks, Colorado Probate Practice Manual. It provides a thorough commentary on the law of wills, trusts, and fiduciary administration, focusing on leading Colorado cases, the Colorado probate code, and related fiduciary statutes.
 
This Eighth Edition contains statutory and case law updates, including discussions of the Revised Uniform Fiduciary Access to Digital Assets Act and the Colorado Uniform Trust Decanting Act, as well as changes to the protective proceedings statutes. Additionally, this Eighth Edition contains an extensive discussion of property distribution under the per capita, per stirpes, by representation, and per capita at each generation models. Case law is also covered, including Independent Bank v. Pandy, In re Estate of DeWitt, Estate of Petteys v. Farmers State Bank, and more.
 
The new materials covered include several legislative developments: the Revised Uniform Fiduciary Access to Digital Assets Act, the Colorado Uniform Trust Decanting Act, and the statute providing for a free-standing determination of interests in property. Significant court decisions involve the Colorado Supreme Court’s reaffirming the strict privity doctrine in Baker v. Wood, Ris & Hames, and the articulation of the common law rule of a revocable trust being the alter ego of the settlor with respect to creditor claims.
