Substantial  Updates to the DUI Benchbook
The DUI Benchbook has been updated annually nearly every year for the past fifteen years. The 2012 Supplement has updates to almost all chapters and is crucial for legal professionals and attorneys to keep current with DUI law. This book, the only one of its kind in Colorado, is written by judges and DUI practitioners and is an essential resource both on the bench and in private practice. As a joint project of Colorado Bar Association CLE and the Colorado County Judges Association, it continues to be the definitive authority on DUI practice in Colorado.

Summary of Important Updates:
  • Updates throughout book to reflect “Rule of 7” timing
  • General updates to most chapters (all but Chapter 5)
  • Chapter 4  was rewritten to add more recent cases and to further explore and clarify 4th and 5th Amendment analyses
  • Chapter 6 includes enlarged discussion on Confrontation Clause issues and recent, somewhat clashing US Supreme Court decisions on this topic (Bullcoming and Williams)
  • Chapter 7 was rewritten to address evidence-based sentencing throughout and provide an update on Colorado's expanding DUI/Drug courts and their policies/experience

Summary of New and Important Case Law:
  • People ex rel. A.G. v. C.M. (Colorado clarification re: judicial recusal) (Chap 1)
  • Lafler v. Cooper and Missouri v. Frye (U.S. Sup. Ct., impact pleas negotiated with assistance of counsel) (Chap 2)
  • People v. Smith (Colorado, defendant's right to refuse chemical test is not absolute) (Chap 3)
  • Bullcoming v. New Mexico (U.S. Sup. Ct., Confrontation Clause requirements) (Chap 6)
  • Williams v. Illinois (U.S. Sup. Ct., Confrontation Clause) (Chap 6)

Updates/Supplements:

Colorado DUI Benchbook is updated annually. If you are updating a book that has a date of 2009 or earlier on the front cover sheet, you must purchase a new book which includes the latest 2012 supplement. If you are updating a book that has a date of 2010 on the front cover sheet, you must purchase the 2011 (Revised) and 2012 supplements to update your book. If the front cover sheet has a date of 2011, you would just need to purchase the 2012 supplement to update your book.
