In 2009, Colorado water law experienced another very active year. One of the most significant developments was the adoption of revised Water Court Rules. The Rules were revised in response to growing concerns that the water court process was not optimized to current, real-world needs and practices. All attorneys practicing water law in Colorado need to familiarize themselves with these new Rules, which are summarized in this chapter. The Colorado General Assembly was also busy passing a number of bills with issues ranging from tax credits for water rights for instream flow purposes donated to the Colorado Water Conservation Board to authorizing creation of acequia mutual ditch companies.
 
In addition to changes in rules and statutes, the Colorado Supreme Court decided a number of cases involving the ongoing issues of state engineer authority
and water court jurisdiction, conditional water rights requirements, and adverse possession. The court of appeals addressed issues including ditch maintenance,
easement rights, and district rights and responsibilities.
