Bankruptcy continued to be a busy area of law during 2009. Indeed, the level of case filings in Colorado — 28,017 for 2009 — is reminiscent of 2004. Business filings increased dramatically during 2009 as compared to the prior few years. While fewer decisions were published by the Tenth Circuit and in the district this year, those opinions that were published plow new ground and answer questions raised by the Bankruptcy Abuse
Prevention and Consumer Protection Act of 2005 (BAPCPA).
Looking forward, both the U.S. Supreme Court and the Tenth Circuit will be addressing a number of issues under BAPCPA during 2010. The Tenth Circuit’s 2008 Lanning opinion will be reviewed on certiorari by the Supreme Court. The Supreme Court’s ultimate holding
in Lanning may significantly impact Chapter 13 practice in Colorado and elsewhere and, conceivably, could impact Chapter 7 practice relating to the means test found in 11 U.S.C. ยง 707(b)(2). Yet, a degree of stability and predictability is returning as more appellate
decisions are issued by the U.S. District Court and the Tenth Circuit Bankruptcy Appellate Panel (BAP).
Significant changes in the Federal Rules of Bankruptcy Procedure and the Local Bankruptcy Rules were implemented on December 1, 2009. These changes are designed to make practice more straightforward with fewer procedural pitfalls. The changes will, however,
challenge practitioners to discard some former mainstays of practice, such as the three-day mailing rule.
Bankruptcy filings have traditionally been a “lagging” economic indicator. As such, 2010 is expected to see increases in filings under all chapters of the Bankruptcy Code even if the economy as a whole improves. All in all, 2010 promises to be another interesting year in which to practice bankruptcy law and hopefully the expected Supreme Court opinions will foster greater clarity and make the increasing volume of cases more manageable.
