Program Description
The trustee's duty to inform is crucial to the trust relationship. It mandates communication between the trustee and the beneficiary, ensures that the beneficiary has the information necessary to allow the enforcement of the trust, and protects the trustee against stale claims after the matter has been closed. The duty to inform is fundamentally mandatory under the Colorado Probate Code, but because some aspects of the duty are subject to a reasonableness standard and there has been little case law interpreting the statute, the exact boundaries of the duty have yet to be delineated.
