For local governments, the year 2010 was highlighted by significant new decisions in federal and states courts in the areas of campaign finance, elections, and petition rights. Another subject with constitutional dimensions - municipal firearms regulation - also drew the attention of the U.S. Supreme Court.
In the areas of zoning, land use, and eminent domain, there was a particularly crowded docket in the state appellate courts in 2010, and in a case arising out of Boulder County, the Tenth Circuit rendered an important new decision interpreting and applying the Religious Land Use and Institutionalized Persons Act. Disputes over municipal annexation powers heated up again in 2010, with the expansive authority of cities and towns to engage in “flagpole annexations” being reaffirmed in the Colorado Court of Appeals.
Meanwhile, in the state legislature, the dominant and overriding issue for all local governments was medical marijuana. The adoption of HB 10-1284 provided a sweeping regulatory framework for medical marijuana.
