For instance, if a represented party calls your office wanting to fire her current attorney and hire you, does a consultation with that client constitute interference in the lawyer-client relationship? What if, when conducting settlement negotiations by e-mail, a lawyer accidentally hits the “reply all” button and submits an offer directly to both the client and the client's lawyer? May a lawyer acting as a mediator or investigator directly contact a represented party on the subject of the litigation? When the party is an entity, may a lawyer directly contact its former employees?
