Program Description:
 
Estate and trust practice involves the volatile intersection of money, family and emotion.  At every step and stage of the representation, substantial ethical issues exist.  How do you spot capacity issues in clients, and what's the risk of a later will contest?  Can you effectively represent husbands and wives, or multiple generations of a single family?  What if property is held in various states - do you need co-counsel?  What are the conflicts inherent in being designated by a client as a fiduciary or even as a beneficiary?  These and many other ethics questions occur frequently.  This program will take a practical approach to identifying ethics issues at each stage of a representation and establishing best practices to avoid ethical complaint.

Faculty:
 
Julia B. Meister is a partner in the Cincinnati office of Taft, Stettinius & Hollister, LLP, and head's the office's estate, trust and fiduciary litigation group.  She counsels clients and represents them in commercial and estate, trust and fiduciary matters before courts, administrative tribunals, and arbitrators, and in professional ethics and discipline matters.  She is a member of the Ohio State Bar Association's Estate Planning, Trust and Probate Law Section Council and served as an adjunct professor of law at the University of Dayton Law School.  Ms. Meister received her undergraduate degree from Xavier University and her J.D. from Notre Dame Law School with honors.
 
William Freivogel is the principal of Freivogel Ethics Consulting and is an independent consultant to law firms on ethics and risk management.  He was a trial lawyer for 22 years and has practiced in the areas of legal ethics and lawyer malpractice for 20 years.  He is chair of the Editorial Board of the ABA/BNA Lawyers' Manual on Professional Conduct and recent past chair of the ABA Business Law Section Committee on Professional Responsibility.  He maintains the Web site “Freivogel on Conflicts” at www.freivogelonconflicts.com.  Mr. Freivogel is a graduate of the University of Illinois (Champaign), where he received his B.S. and LL.B.
