Program Description:
Over the last decade, courts have refined the obligations of parties to preserve and collect paper and electronic documents. The continual and rapid changes in technology and the expansion of media on which people create and store information have made these obligations increasingly important in civil litigation.
This program will examine the Pension Committee v. Banc of America Securities decision, in which Judge Shira Scheindlin of the Southern District of New York set out significant new law concerning discovery obligations, this time focusing on those who are negligent or grossly negligent in failing to preserve electronic and paper documents.
Mr. Durling will:
-review Judge Schiendlin's key role in developing discovery rules
-analyze the Pension Committee decision
-consider the impact its holding will have on discovery issues in Colorado

Caleb Durling
Reilly Pozner LLP
Caleb Durling is an associate attorney at Reilly Pozner LLP. Caleb's practice focuses on complex civil and commercial litigation and appeals. Prior to joining Reilly Pozner, Caleb was a law clerk for Chief Justice Mary Mullarkey of the Colorado Supreme Court. He graduated with honors from the Northwestern University School of Law in 2007. In law school, he served as the Executive Editor of the Journal of Criminal Law and Criminology and won the publication's 2006-2007 Lowden-Wigmore Award for Best Comment. Caleb graduated cum laude from Northwestern University in 2001 where he earned a B.A. in American Studies. Before going to law school, he taught for two years in inner-city Atlanta as a member of Teach for America and an additional year on a housing project near London, England. Caleb was recognized as a finalist for Law Week's 2010 Up and Coming Lawyers.
