Program Description:
A point/counterpoint discussion by Jack Tanner and Gerald Pratt, both members of the CBA Ethics Committee, on whether surreptitious recording by attorneys is, or should be, considered unethical. The debate will include discussion of CBA Ethics Opinion 112, existing Colorado legal authority, the affect of changing technology, in the areas of civil cases, criminal cases, and lawyers' private conduct.

About the Faculty:
Jack Tanner
Fairfield and Woods PC
John “Jack” Tanner is a director at Fairfield and Woods PC in Denver. He helps solve business disputes by employing many tools, including negotiation, alternative dispute resolution, and both traditional and atypical litigation tactics. He has represented clients in all aspects of commercial litigation, including contract disputes, receiverships, intellectual property, and construction matters. Jack is proud to have represented Microsoft, tw telecom inc. f/k/a Time Warner Telecom, and the Denver Museum of Nature and Science. Jack has practiced with Fairfield and Woods PC since 1987 and was chair of the litigation department from 2000 to 2005. Prior to entering private practice, he served as law clerk to Justice (later Chief Justice) Luis Rovira of the Colorado Supreme Court. He has been on the CBA Ethics Committee since 1996 and is a frequent lecturer on legal ethics, particularly ethics for in-house counsel.
Gerald Pratt
McConaughy & Sarkissian PC
Gerald Pratt, Esq. is Of Counsel with McConaughy & Sarkissian PC. He received his Juris Doctorate degree from the University of Denver College of Law in 1981, and he is licensed to practice in all Colorado state courts, the United States District Court for the District of Colorado, and the Tenth Circuit Court of Appeals. He has been lead counsel in over 80 trials involving professional negligence; products liability; personal injury; premises liability; insurance bad faith; employment law; medical, dental, and legal malpractice; and criminal defense. Mr. Pratt also advises lawyers on ethical issues and represents them in attorney regulation matters. He is a prolific contributor to various legal journals, including The Colorado Lawyer, and a frequent presenter for the Denver and Colorado Bar Associations. He has been a member of the Colorado Bar Association Ethics Committee since 1984 and served as chair of that committee in 2002-2003. He also has been a member of the Colorado Bar Association Lawyers Professional Liability Committee since 2001 and has served as chair of that committee since September 2010. He has accepted pro bono cases from the Metro Volunteer Lawyers (formerly Thursday Night Bar) since 1982.
