Program Description:
 
Colorado Formal Ethics Opinion 96, “Ex Parte Communications with Represented Persons During Criminal and Civil Regulatory/Investigations and Proceedings,” was recently amended. This program will discuss the changes in the amended opinion. The program will also review the scope and application of Colo. RPC 4.2 in the context of such investigations and proceedings, including a review of factors affecting whether communications with a represented person are permitted.

Matthew Kirsch, Esq., is the chief of the Economic Crimes Section of the United States Attorney's Office for the District of Colorado. He has been an AUSA for thirteen years and has specialized in prosecuting white collar crime for approximately ten years. He received his undergraduate degree from Harvard and his law degree from Duke. Matt also serves on the Executive Council of the Colorado Bar Association (CBA) Criminal Law Section and on the CBA Ethics Committee.
