Malpractice Prevention: Lawyers' Duties to Prospective Clients and Non-Clients - LIVE IN DENVER
Program Description:
What are your duties to prospective clients or to people who hit you up for free legal advice at parties? What is your exposure when you prepare opinion letters that you know your clients will provide to third-parties? This one-hour program will address your ethical responsibilities and professional liability issues when meeting with prospective clients and when communicating with people who are not your clients. The program will review Colo. RPC 1.18, “Duties to Prospective Client,” the Colorado Supreme Court's decision in Allen v. Steele, 252 P.3d 476 (Colo. 2011) regarding negligent misrepresentation claims against lawyers, and will discuss other potential claims that can arise out of lawyers' dealings with non-clients. The program will address practical steps that you can take when dealing with prospective clients and third-party non-clients to minimize the risk of a lawsuit against you.

About the Faculty:
Michael Mihm's practice focuses on representing plaintiffs in legal malpractice lawsuits and commercial and business tort litigation. Before forming Starrs Mihm LLP in 2003, Mr. Mihm spent 18 years with one of Colorado's larger defense firms representing lawyers in malpractice cases. Mr. Mihm has been selected by his peers for inclusion in The Best Lawyers in America® in the field of Legal Malpractice Law - Plaintiff, as well as in Colorado Super Lawyers® in the field of Professional Liability-Plaintiff. Mr. Mihm has for many years served as the managing editor of Lawyers' Professional Liability in Colorado, Second Ed. (Michael Mihm ed., CLE in Colorado, Inc., 2005, Supp. 2011), and he authored a number of chapters in the book. He serves on the Board of Directors for CLE in Colorado, Inc., and he is an elected officer of the Colorado Trial Lawyers Association. Mr. Mihm is a 1983 graduate of the University of Southern California Gould School of Law, and he is admitted to practice in state and federal courts in both Colorado and California.
