Program Description:
Over the last several decades, alternative methods for addressing conflicts among private citizens have received increasing attention. This movement has been driven by a number of factors inherent in the public court system: (1) delays, (2) expense, (3) formality, and (4) uncertainty. As a result, alternatives to the public court system continue to develop. This program examines the various forms of alternative dispute resolution (ADR) that have been most successful and that offer the most promise. Attorneys will benefit from understanding these alternatives, and will learn:
- How to prepare for the various kinds of ADR;
- How they work and when they are viable;
- How to counsel clients on each kind; and
- How to use them successfully.

About the Faculty:

C. Jean Stewart, Esq., is Of Counsel to Holland & Hart LLP where she is a member of the Fiduciary Solutions Practice Group. She provides services as an Appointed Judge under C.R.S. §13-3-111, as a special master under C.R.C.P. 53, and as an arbitrator and mediator. Ms. Stewart served for over 16 years as the Presiding Judge of the Denver Probate Court where she developed and implemented numerous efficiencies in the court, including electronic filing, a variety of volunteer programs, and a website devoted to assisting the practicing bar and pro se litigants gain access to the court. She is currently a member of the Executive Committee of the National College of Probate Judges, a member of the Task Force charged with revision and update of the National Probate Court Standards, a Fellow of the American College of Trust and Estate Counsel, past chair of the Probate and Trust Law Section of the Colorado Bar Association and Past President of the Denver Estate Planning Council. She is also a member of the American Bar Association and Colorado Bar Association Sections on Dispute Resolution.
